This Acceptable Use Policy ("AUP") governs all use of TheCloud.market services including shared hosting, VPS, cloud storage, email hosting, and domain registration. By using our Services, you agree to comply with this AUP. Violations may result in immediate suspension or termination of your account without refund.
1. Purpose
TheCloud.market provides hosting infrastructure to enable legitimate online presence and business operations. This AUP exists to protect the integrity, security, and performance of our platform, the safety of our other customers, and compliance with applicable Indian and international laws. All customers, resellers, and end users of services hosted on our infrastructure are bound by this policy.
2. Prohibited Content
Zero Tolerance:The following categories of content are strictly prohibited on our infrastructure and will result in immediate termination without notice or refund.
2.1 Illegal Content
Any content that violates the laws of India, including the Information Technology Act 2000, IT (Amendment) Act 2008, Indian Penal Code, and all applicable state laws
Child sexual abuse material (CSAM) or any content that sexualises minors in any form
Content promoting, glorifying, or facilitating terrorism, extremism, or violence against any individual or group
Content related to drug trafficking, arms dealing, or any other illegal trade
Pirated software, cracked applications, warez, or illegally distributed copyrighted material
2.2 Harmful and Malicious Content
Malware, ransomware, spyware, trojans, viruses, or any malicious code
Phishing pages, fake login portals, or any content designed to fraudulently collect user credentials or financial information
Botnets, command-and-control servers, or infrastructure used to conduct cyberattacks
Tools or scripts designed to compromise the security of third-party systems
Cryptomining software or scripts that exploit server or visitor resources without explicit consent
2.3 Harmful Speech and Harassment
Content that constitutes hate speech, incites violence, or discriminates on the basis of religion, race, caste, gender, nationality, or sexual orientation
Content used to harass, bully, stalk, or threaten any individual
Doxxing - publishing private or personally identifiable information about individuals without consent
3. Prohibited Activities
3.1 Network and Security Abuse
Conducting or facilitating Distributed Denial of Service (DDoS) attacks against any target
Port scanning, vulnerability scanning, or probing of systems you do not own or have explicit written permission to test
Attempting to gain unauthorised access to any system, network, or data
IP spoofing, packet injection, or any form of network traffic manipulation
Operating open proxies, Tor exit nodes, or anonymous relay services without prior written approval from TheCloud.market
3.2 Email and Spam Abuse
Sending unsolicited bulk email (spam) in any form or volume
Operating open mail relays that can be exploited by third parties
Sending email that violates India's TRAI regulations, the IT Act, or the CAN-SPAM Act
Harvesting, scraping, or purchasing email lists for bulk distribution
Forging email headers, spoofing sender identities, or impersonating other domains
3.3 Resource Abuse
Consuming excessive CPU, RAM, bandwidth, or storage in a manner that degrades performance for other customers on shared infrastructure
Running persistent background processes, cryptocurrency miners, or resource-intensive scripts on shared hosting plans
Circumventing any resource limits or quotas imposed by your service plan
Reselling or sub-licensing our Services without authorisation in your service agreement
3.4 Intellectual Property Violations
Hosting websites or content that infringe on trademarks, patents, copyrights, or other intellectual property rights of third parties
Operating counterfeit storefronts or brand impersonation websites
Distributing cracked software, illegal media streams, or pirated digital content
4. Reseller and Agency Responsibilities
If you are a reseller or agency using TheCloud.market infrastructure to provide services to your own clients, you are fully responsible for ensuring that your end customers comply with this AUP. You must:
Incorporate equivalent acceptable use terms in your own customer agreements
Promptly respond to abuse complaints forwarded to you by TheCloud.market
Take immediate action to suspend or terminate end-user accounts that violate this AUP
TheCloud.market reserves the right to act directly against end-user accounts if a reseller fails to take timely action on an abuse complaint.

If you become aware of any content or activity on our platform that violates this AUP, please report it immediately:

We treat all abuse reports seriously and aim to investigate and respond within 24 to 48 hours of receipt.
6. Enforcement
6.1 Investigation
Upon receiving an abuse complaint or detecting a potential violation, we will investigate the matter. We reserve the right to access, review, and take action on content or account activity as necessary to enforce this AUP.
6.2 Actions We May Take
Depending on the severity and nature of the violation, we may take one or more of the following actions:
Issue a formal warning requiring corrective action within a specified timeframe
Temporarily suspend the offending service or account
Remove or disable the specific content or service in violation
Permanently terminate the account and all associated services without refund
Report the activity to law enforcement authorities in India or other jurisdictions
Pursue civil or criminal legal remedies
6.3 No Obligation to Monitor
TheCloud.market does not proactively monitor all customer content. However, we reserve the right to investigate and act upon complaints or violations that come to our attention. Acting on some violations does not obligate us to act on all violations.
7. Safe Harbour - IT Act Section 79
TheCloud.market operates as an intermediary under Section 79 of the Information Technology Act, 2000. We are not liable for third-party content hosted on our infrastructure provided we act expeditiously to remove or disable access to content upon actual knowledge of violation or receipt of a government or court order. This AUP forms part of our due diligence obligations under the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
8. Changes to This Policy
We may update this AUP at any time. Continued use of our Services after changes are published constitutes acceptance of the revised policy. Significant changes will be communicated via email to your registered address.
